This website is operated by Hershey's Houseplants. Throughout the site, the terms &aquot;we&aquot;, &aquot;us&aquot; and &aquot;our&aquot; refer to Hershey's Houseplants. By visiting our site and/or purchasing something from us, you engage in our &aquot;Service&aquot; and agree to be bound by the following terms and conditions.

2. Products & Live Plants

Nature of Goods: You acknowledge that you are purchasing live plants. While we strive to provide accurate photos, for &aquot;Grower's Choice&aquot; or seedling listings, the plant you receive may vary slightly in size or leaf shape from the representative photo.

Cosmetic Imperfections: Minor damage due to shipping stress (such as a yellowing leaf, bent petiole, or minor mechanical damage) is a normal risk of shipping live plants and is not considered a defect.

3. Billing & Payment Terms

Payment Methods: We accept Visa, Mastercard, American Express, Discover, PayPal, Shop Pay, Google Pay, and other methods as displayed at checkout.

Timing of Charges: You will be charged in full at the time you place your order. We do not offer &aquot;net 30&aquot; terms or payment upon delivery.

Order Cancellation: We reserve the right to refuse any order you place with us. In the event that we make a change to or cancel an order, we will notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made.

4. Shipping & Returns

Final Sale: All sales of live plants are final. We do not accept returns for change of mind.

Arrive Alive Guarantee: Please review our Shipping & Returns page for specific details on how we handle plants damaged in transit. You must contact us within 24 hours of delivery with photos to be eligible for any resolution.

5. Intellectual Property

All content included on this site, such as text, graphics, logos, images, and data compilations, is the property of Hershey's Houseplants or its content suppliers and protected by United States and international copyright laws.

6. Governing Law

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the State of Illinois.
